Comet Terms and Conditions
Version 2026-10-en-v6.2. Last updated: 16 October 2026. In effect on 16 October 2026.
1. Acceptance
By creating an account, buying Comet+ or using Comet ("the app", meaning the app on iPhone, iPad and Android and the web app), operated by Aerolith Technology Inc. ("Aerolith", "we", "us", "our"), you agree to these Terms and Conditions. If you do not agree, please do not use the app.
2. Who can use Comet
The app applies an age threshold based on the date of birth and region entered at sign-up: 14 in Quebec; for other regions, see Section 7 of our Privacy Policy. From that threshold, a swimmer can register and consent for themselves. Under that threshold, the account is activated only with the consent of the parent or guardian, who consents on the swimmer's behalf and is the account holder.
The parent or guardian who holds a minor's account is the contracting party under these Terms and is responsible for supervising the swimmer's use of the app. The swimmer is an authorized user under that account.
3. Your account
You create your account with an email address and a password. If you buy Comet+ on our website, your account is created from the email address entered at checkout, and you then complete it; if a Comet account already uses that address, the purchase is attached to that account once you sign in to it. If you already have an account, you can also sign in to it in the app with Apple or Google. You are responsible for the accuracy of your profile information, in particular your date of birth and region, which determine your age category and the application of the protections for minors.
If you hold an account, you are responsible for keeping your login details secure and for activity under your account. Where the account belongs to a swimmer under their region's age threshold, the parent or guardian who holds the account carries that responsibility. Your public profile, if it is on (it is on by default for an account created at age 14 or older), is visible to other swimmers signed in to Comet (Privacy Policy, Section 6.4); you can turn it off at any time in Settings. Please tell us promptly if you suspect unauthorized use.
4. The service
Comet lets swimmers record and view their sessions, races, times and splits, follow their progress and, with a Comet+ subscription, use additional features described in the app, including Coach+ and official results import. Comet also lets clubs follow the swimmers who join them. We may add, change, or remove features over time.
5. Demo mode and sample content
The app offers a demo mode populated with fictional sample swimmers, accessible without an account, as well as an option letting subscribers view that sample data from their profile. This data is provided for illustration only: it is neither real data nor a promise of results. In demo mode, the stopwatch runs without recording and features requiring an account or a subscription are unavailable.
6. Acceptable use
You agree not to misuse the app, including by attempting to access another user's data, interfering with the service, or using it for any unlawful purpose.
7. Your data and content
You keep your rights in the swim data associated with the account. You grant us the limited permission we need to store, process and display that data, including to provide Coach+ and, if it is on, your public profile, as described in our Privacy Policy. Our handling of personal information is governed by the Privacy Policy.
Usage measurement. To fix problems and improve the app, we measure how it is used: screens opened, features used, errors encountered and technical details (app version, system, device model, language, theme, time zone, network state). This data is tied to your account through a pseudonym, never your name or email. It contains no text you type, no precise location and no advertising identifier. It is processed in our own database: no third party analytics tool receives it, we do not sell it and we do not use it for advertising. Detailed events are deleted after 90 days or with your account; only anonymous daily totals are kept. Nothing is recorded in demo mode. This measurement also applies to accounts belonging to a minor. You may object at any time by writing to privacy@aerolith.tech, with no effect on the features available to you. Details: Privacy Policy, Section 8.
Coach+. You are responsible for what you write to Coach+; do not enter another person's personal information. Coach+'s answers are provided for your personal training use (see Section 12).
8. Joining a club
If you join a swim club, you consent to that club and its coaches viewing the information described in Section 6.3 of our Privacy Policy (https://cometswim.com/privacy), including your shared sessions with their times, your official competition results, with the category published by the federation and the standards reached, and your birth month and year if sharing is on and, for a coach who has you in their group, their notes, your perceived effort and your wellness signals. A consented club membership turns on sharing of your new sessions by default, as announced at the moment you accept; each session you recorded yourself can be set back to private, at any time. Sharing of your competition results and birth month is turned on when you join, on the screen that announces it, or later with a tap in the app, and can be stopped at any time from your profile without leaving the club. Joining is voluntary, can be declined without any consequence for your use of the app, and can be revoked at any time from your profile. The dashboards offered to clubs cannot modify the sessions you recorded or act on your account.
Club accounts. A club that creates a Comet account agrees to use its swimmers' information only for their athletic supervision, not to disclose it to third parties, and to respect a swimmer's choice to make a session private or to leave the club.
9. Intellectual property and licence
The app, including its software, design, and branding, belongs to Aerolith Technology Inc. or its licensors. You may not copy, modify, or distribute it except as allowed by law.
Licence. Subject to these Terms, Aerolith grants you a personal, limited, non-exclusive, non-transferable and revocable licence to download, install and use the app on devices you own or control, for your personal, non-commercial use or, for a club account, to supervise its swimmers. If you get the app from the App Store, this licence is limited to Apple-branded devices you own or control and to the use permitted by the Usage Rules in the App Store terms. You may not rent, lend, sell, redistribute or sublicense the app, or decompile, disassemble or attempt to derive its source code, except to the extent the law expressly permits.
Updates. We may release updates to the app. Some may be required to keep using it, for example for security or compatibility reasons; the app may then ask you to update before you continue.
Terms specific to Apple's App Store. If you got the app from the App Store:
- these Terms are concluded between you and Aerolith only, and not with Apple Inc. ("Apple"); Aerolith, not Apple, is solely responsible for the app and its content;
- Apple has no obligation to provide maintenance or support services for the app; support is provided by Aerolith at support@cometswim.com;
- if the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are Aerolith's sole responsibility;
- Aerolith, not Apple, is responsible for addressing any claim relating to the app or your use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or privacy law, including in connection with the app's use of Apple's HealthKit framework (Apple Health);
- in the event of a third-party claim that the app or your use of it infringes that third party's intellectual property rights, Aerolith, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim;
- you represent that you are not located in a country subject to a United States Government embargo or designated by it as a terrorist-supporting country, and that you are not listed on any United States Government list of prohibited or restricted parties;
- you must comply with applicable third-party terms when using the app, for example those of your wireless carrier;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
Google Play. If you got the app from Google Play, the Google Play terms also apply to your use of that store.
Contact for any question, complaint or claim about the app: Aerolith Technology Inc., support@cometswim.com.
10. Third party services
The app relies on third-party services, for example hosting, authentication, email and notification delivery, payment (Apple, Google and Stripe) and Coach+'s artificial intelligence (Anthropic). It also lets you use third-party services you choose: sign-in with Apple or Google, Apple Health and, for beta programme testers, Strava. Your use of those services may be subject to their own terms. We are not responsible for those third parties' own services or terms, and a connection may stop working if the third party changes or withdraws it.
11. Comet+ subscription (auto-renewing)
Plans and prices. Comet+ is offered as an auto-renewing subscription, annual or monthly, in the App Store (Apple), in Google Play (Google) or on our website. The price, the currency and, where relevant, the length of the free trial and the taxes are shown before purchase; the price shown at the time of purchase prevails. A subscription gives access to Comet+ for a single Comet account; Comet+ is not available through Family Sharing.
11.1 Purchase in the App Store or Google Play
Free trial. The annual plan includes a seven (7) day free trial and the monthly plan a three (3) day free trial. At the end of the trial, the subscription converts automatically and the price of the chosen plan is charged to the payment method associated with your Apple or Google account, unless you cancel at least 24 hours before the end of the trial. Only one free trial is offered per Apple or Google account, across all plans.
Renewal and cancellation. The subscription renews automatically each period, unless you cancel at least 24 hours before the end of the current period. Cancellation is done in your Apple account settings (Settings > Subscriptions) or Google Play (Payments and subscriptions); deleting the app does not cancel the subscription. Cancellation takes effect at the end of the paid period: you keep full access until then.
Billing and refunds. Purchases and billing are processed by Apple (App Store) or Google (Google Play), acting as merchants of record; Aerolith cannot process App Store refunds directly, and Google Play refunds follow Google's process. Refund requests are made with the relevant store, under its policies: Apple at https://reportaproblem.apple.com, Google through the Google Play refund flow (https://support.google.com/googleplay/answer/2479637).
11.2 Purchase on our website
Seller. A subscription bought on our website is sold by Aerolith Technology Inc., support@cometswim.com, acting as merchant of record. Payment is processed by Stripe; Aerolith never receives your card numbers.
Prices and taxes. On our website, Comet+ costs CAD $84.99 per year or CAD $13.99 per month, or USD $59.99 per year or USD $9.99 per month, depending on the currency shown before payment. Depending on the currency shown, it may also cost €53.99 per year or €8.99 per month, £44.99 per year or £7.99 per month, or AUD $84.99 per year or AUD $13.99 per month, and these prices in euros, pounds sterling and Australian dollars include applicable taxes. Prices in Canadian dollars and US dollars are before taxes: applicable taxes, such as GST or HST and QST, are calculated from your billing address, added to the price and shown before payment.
No free trial. A website purchase does not include a free trial: the first payment is charged at purchase.
Acceptance and account. Before payment, you tick a box by which you accept these Terms, including automatic renewal, how often and at what price the subscription renews, how to cancel and the refund rule, which are restated next to the box. If you live in the European Union, the European Economic Area or the United Kingdom, you also tick, before payment, a box by which you ask for immediate access to Comet+ and acknowledge that you lose your right of withdrawal once access has started (see "Right of withdrawal" below). Your Comet account is then created from the email address entered at checkout; if an account already uses that address, the purchase is attached to it once you sign in to it.
Promotion codes. A promotion code may be applied at checkout, under the terms given with the code.
Renewal. The subscription renews automatically at the end of each period, at the price then in effect, and the amount, plus applicable taxes for a price in Canadian or US dollars, is charged to the saved payment method, unless you cancel before the renewal date. For an annual subscription, we send you a reminder email 30 days before each renewal, with the renewal date and amount and how to cancel.
Cancellation. You can cancel at any time, up to the day before renewal, in Comet on the web, under Settings › Manage my subscription, which opens Stripe's secure portal, or by writing to support@cometswim.com. Cancellation takes effect at the end of the paid period: you keep full access until then. Deleting the app does not cancel the subscription; for account deletion, see Section 15.
Refunds. Within 14 days of the first payment of a subscription bought on our website, we refund that payment in full on simple request to support@cometswim.com. The refund ends the subscription and access to Comet+ as soon as it is made; your account and your training data are kept. After that period, and for renewals, payments are not refunded, unless the law requires it; cancelling stops future renewals. A purchase we refuse, for example a second subscription for an account that already has one, is cancelled, and its payment is refunded on request to support@cometswim.com. Nothing in these Terms limits a right to cancel, rescind, withdraw or obtain a refund that the law of the place where you live gives you.
Right of withdrawal (European Union, European Economic Area and United Kingdom). If you live in one of these territories, the law gives you a right to withdraw from the contract within 14 days of its conclusion, without giving any reason. Comet+ starts as soon as you pay: before payment, we ask you to tick a box by which you ask for immediate access and acknowledge that you lose your right of withdrawal once access has started. We confirm this request in the confirmation email. If you did not make this request, you can withdraw within 14 days of payment by telling us clearly, for example by writing to support@cometswim.com or with the form below; we then refund the payment in full, to the payment method used, no later than 14 days after your request, and access to Comet+ ends. In every case, the refund in the previous paragraph remains available within 14 days of the first payment.
Withdrawal form (complete and send only if you want to withdraw): "To Aerolith Technology Inc., support@cometswim.com: I hereby give notice that I withdraw from my contract for the Comet+ subscription below. Ordered on: ... Name: ... Email address used at checkout: ... Date: ..."
Confirmation. After payment, we send you a confirmation email, separate from Stripe's receipt, that restates the plan, the automatic renewal, its price, how to cancel, the refund rule and, where applicable, your request for immediate access or your right of withdrawal. Keep it: it confirms the terms of your subscription. We also keep a record of what you accepted at payment (text versions, date and time), with the billing records.
11.3 Common terms
Purchases by a minor. In the app, the purchase screen is never shown to an identified account under 13. In the App Store and Google Play, the store's parental controls apply when they are turned on (for example Apple's "Ask to Buy" or Google's Family Link). On our website, the subscription is taken out by the person who pays; if you are a minor, get your parent or guardian's agreement before buying. For a swimmer under their region's age threshold, the account is activated only after the parent or guardian consents, even if the subscription was already bought.
Expiration. When the subscription expires, your account and your training data are kept. You keep the home screen, your sessions, your profile, the settings and the stopwatch; the features reserved for Comet+, for example Progress, Standards, Training, Challenges and Coach+, become available again as soon as you resubscribe.
Price changes. We may change subscription prices. For a subscription bought in the App Store or Google Play, any change is communicated to you in advance through the store's mechanisms. For a subscription bought on our website, we tell you by email at least 30 days before the renewal concerned. In both cases, the change applies only from the next renewal and you can cancel before it takes effect.
End of beta access. The free Comet+ access offered to beta programme testers ends on 15 October 2026. To keep using Comet+, a former tester subscribes; their data is kept.
12. No coaching or medical advice
Comet, including Coach+, provides tracking and information only. It does not provide medical, health, or professional coaching advice. Decisions about training and health should be made with a qualified coach or healthcare professional.
Coach+ is an artificial intelligence assistant. Its answers, the workouts it suggests and its dryland routines are generated automatically by an artificial intelligence model (Anthropic), from the information available. They are neither coaching nor medical advice, and they may be inaccurate, incomplete or unsuited to your situation. Check them with your own judgment and, where needed, with your coach. Stop any exercise if you feel pain, dizziness or discomfort, and see a healthcare professional. A minor swimmer does dryland exercises under the supervision of an adult or their coach. Coach+ does not replace a qualified coach, a healthcare professional or your pool's safety rules. Coach+ changes your log only at your request, and the app asks you to confirm any deletion.
13. Disclaimers
The app is provided "as is" and "as available." To the extent permitted by law, we disclaim warranties that the app will be uninterrupted, error free, or fit for a particular purpose.
14. Limitation of liability
To the extent permitted by law, Aerolith Technology Inc. is not liable for indirect, incidental, or consequential damages arising from your use of the app. Nothing in these Terms limits liability that cannot be limited by law.
15. Suspension, termination, and account deletion
The account holder may stop using the app and close the account at any time. We may suspend or end access if these Terms are breached or if we discontinue the service. On termination, we handle your data as described in the Privacy Policy.
You can ask for your account to be deleted at any time in the app (Settings › Privacy › Delete my account) or, without the app, by writing to privacy@aerolith.tech from your account's email address. Your account is then deactivated and your personal information is erased as set out in our Privacy Policy (Section 11), except in particular for billing and subscription records, which are kept for seven (7) years under our legal obligations. Deleting the account does not cancel a subscription bought in the App Store or Google Play: cancel it with Apple or Google (see Section 11.1). A request to delete the account also cancels, immediately, a subscription bought on our website: no further payment is charged, and the current period is not refunded automatically. If your account is linked to Sign in with Apple, deleting it in the app on iPhone or iPad also has us ask Apple to remove Comet's access to your Apple ID.
16. Changes to these Terms
We may update these Terms. We will post the updated version with a new date and version number, and we will tell you about any significant change by email or by a notice in the app before it takes effect. Continued use of the app after an update takes effect means you accept the change. If you refuse it, you can stop using the app, cancel your subscription and delete your account.
17. Governing Law, Forum, and Dispute Resolution
Governing law. These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
Forum and venue. Subject to the arbitration provision below, you and Aerolith agree that the courts of the judicial district of Terrebonne, Province of Quebec, have exclusive jurisdiction over any dispute, and you consent to the personal jurisdiction and venue of those courts.
Arbitration on demand. Either party may elect to resolve a dispute by binding arbitration rather than in court. Where a party demands arbitration in writing, the dispute will be referred to and finally resolved by a single arbitrator under the Arbitration Rules of the ADR Institute of Canada (ADRIC), seated in Montréal, conducted in French, with the arbitrator's decision final and binding. Absent such a demand, the courts identified above retain jurisdiction. Nothing in this section requires either party to arbitrate, and either party may seek injunctive or interim relief from a court at any time.
Mandatory consumer rights preserved. Nothing in these Terms waives, limits, or overrides any right or protection that applicable consumer-protection law grants you and that cannot lawfully be waived, including any non-waivable right to bring or defend proceedings in your place of residence. In Australia, nothing in these Terms excludes, restricts or modifies the consumer guarantees under the Australian Consumer Law.
Language. These Terms are drawn up in French. A version in another language may be provided for convenience; in the event of any conflict or discrepancy, the French version prevails.
